The Municipal Assemblies of People's Power, constituted in the political-administrative districts into which the national territory is divided, are the highest local organs of State power and, consequently, are vested with the highest authority for the exercise of State functions in their respective districts and for this purpose, within the framework of their competence, and in accordance with the law, they exercise government. In addition, they assist in the development of the activities and the fulfillment of the plans of the units established in their territory that are not subordinated to them, in accordance with the provisions of the law.

 

The Local Administrations constituted by these Assemblies direct the economic, production and service entities of local subordination, with the purpose of satisfying the economic, health and other welfare, educational, cultural, sports and recreational needs of the community of the territory to which the jurisdiction of each one extends. For the exercise of their functions, the Local Assemblies of People's Power rely on the People's Councils and on the initiative and broad participation of the population and act in close coordination with the mass and social organizations.

 

The People's Councils are constituted in cities, towns, neighborhoods, villages and rural areas; they are vested with the highest authority for the performance of their functions; they represent the demarcation where they act and at the same time are representatives of the organs of municipal, provincial and national People's Power. They work actively for the efficiency in the development of production and service activities and for the satisfaction of the welfare, economic, educational, cultural and social needs of the population, promoting the greatest participation of the population and local initiatives for the solution of their problems. They coordinate the actions of the existing entities in their area of action, promote cooperation among them and exercise control and supervision of their activities.

 

The People's Councils are constituted from the delegates elected in the constituencies, who must choose among themselves who will preside over them. Representatives of the mass organizations and of the most important institutions in the demarcation may belong to them.

 

Attributions of the Municipal Assembly of People's Power:

  • To comply with and enforce the laws and other provisions of a general nature adopted by the higher organs of the State.
  • To elect and revoke the President and Vice President of the Assembly.
  • To appoint and replace the Secretary of the Assembly.
  • To exercise the supervision and control of the entities of municipal subordination, relying on its working commissions.
  • To revoke or modify the agreements and provisions of the bodies or authorities subordinate to it, which violate the Constitution, the laws, decree-laws, decrees, resolutions and other provisions issued by the superior bodies of the State or which affect the interests of the community, of other territories, or the general interests of the country, or to propose their revocation to the Council of Ministers, when they have been adopted on the basis of powers delegated by the bodies of the Central Administration of the State.
  • Adopt agreements and dictate dispositions within the framework of the Constitution and the laws in force, on matters of municipal interest and control their application.
  • To appoint and replace the members of its Administrative body at the proposal of its President.
  • To determine, in accordance with the principles established by the Council of Ministers, the organization, operation and tasks of the entities in charge of carrying out economic, production and services, health and other welfare, educational, cultural, sports, environmental protection and recreational activities, which are subordinated to its Administrative body.
  • To propose the creation and organization of Popular Councils, in accordance with the provisions of the law.
  • To constitute and dissolve work commissions.
  • Approve the economic-social plan and the budget of the municipality, in accordance with the policies drawn up for this purpose by the competent agencies of the Central State Administration, and control its execution.
  • To contribute to the development of the activities and the fulfillment of the production and service plans of the entities located in its territory that are not subordinated to them, for which purpose they may rely on their work commissions and their administrative body.
  • To know and evaluate the accountability reports submitted by its administrative body and to adopt the pertinent decisions on them.
  • To attend to all matters related to the application of the cadre policy drawn up by the higher State bodies.
  • To strengthen legality, internal order and the defensive capacity of the country.
  • Any other duties assigned to it by the Constitution and the laws.
