The basic cell of the entire structure of the Cuban People's Power is the circumscription, whose conception and operation converge essentially in the figure of the Delegate and represents the most legitimate and authentic contributions of our democratic system.

The circumscription is not an organ of the People's Power. It does not constitute an intermediate instance for the purposes of the political-administrative division. It does not have subordinate administrative structures. The number of electoral districts of the Municipality is determined for each election by the Provincial Electoral Commission, at the proposal of the respective Municipal Electoral Commission, on the basis of the following rules:

 

The constituency, due to its territorial extension and number of electors, must allow each delegate to effectively perform his functions and facilitate full interrelation with his electors, as well as their communication with him, fundamentally during non-working hours.
Constituencies should be as uniform as possible with respect to the number of inhabitants.
Every population settlement, however small and remote it may be, must be represented in the organs of the People's Power.

 

The electoral districts are created in each municipality on the basis of the number of inhabitants in cities, towns, villages, towns and hamlets or dispersed. The constituency shall have a minimum of 200 inhabitants and a maximum of 3,000. In each constituency a delegate is elected to integrate the Municipal Assembly of People's Power.

Duties of the Delegates:

  • To inform the Assembly and the Administration of the locality of the opinions, needs and difficulties communicated to them by their constituents.
  • To inform his electors of the policy pursued by the Assembly and the measures adopted for the solution of needs raised by the population or the difficulties encountered in resolving them.
  • To render a periodic account to their constituents of their personal management, and to inform the Assembly or the committee to which they belong about the fulfillment of the tasks entrusted to them, when required to do so.
  • To attend the sessions of the Municipal Assembly and meetings of the commissions and People's Councils of which they are members.
  • To comply with the resolutions of the Municipal Assembly as far as they are concerned.
  • Comply in due time and form with the information requested by the Municipal Assembly or the People's Council of which they are a member.
  • To be part of the Popular Council organized in their area.
  • Manage the solutions and answers to the questions formulated by the electors.
  • To attend to the voters in periodically scheduled meetings.
  • Any other duties attributed to them by the Constitution, the laws and the Regulations of the Municipal Assemblies.

 

 

Delegates' Rights:

  • To participate with voice and vote in the sessions of the Municipal Assembly and in the meetings of the commissions and Popular Councils of which they are members.
  • To vote in all elections held by the Municipal Assembly and to be elected to the offices to be elected by said Assembly and the People's Council to which he/she belongs.
  • To make proposals on all matters on which the Municipal Assembly is empowered to adopt resolutions.
  • To address questions to the president, vice-president and secretary of the Assembly, to the members of the working commissions, to the members of the Municipal Administration Council and to the administrative directors of the entities located in the territory.
  • To propose to the Municipal Assembly the initiation of the process of revocation of the mandate of another delegate to the municipal or provincial Assembly or of a deputy to the National Assembly, in accordance with the provisions of the law.
  • To submit to the Municipal Assembly the proposal for the revocation of the election or appointment to fill State positions that fall within its competence, in accordance with the provisions of the law.
  • To request the inclusion of items in the Agenda of the sessions of the Municipal Assembly, stating the necessary arguments.
  • To periodically receive information on the management of the Municipal Assembly, its Board of Directors and the work projection of the territory, in order to help prepare it for the fulfillment of its functions.
  • To receive, by way of identification of their condition of delegate, the card and seal, which they may use in their functions.
  • Any other right recognized by the Constitution, the Laws and the Regulations of the Municipal Assembly.

 

 

Frequently asked questions about the work of the Delegate:

 

Is the Delegate the highest authority in the constituency?

The Delegate is the natural leader of the community, freely elected by the citizens, but he/she is not the highest authority in the constituency. In the constituency the highest authority is not the elected Delegate, but the whole of all the electors who elected him/her. And in this fact resides the essential, which makes real the participation of the masses in the state power, which makes possible the real exercise by them of that power.

 

Who can be elected delegates to the Municipal Assemblies of People's Power?

Any Cuban who is in full enjoyment of his political rights, possesses an adequate level of education and has reached 16 years of age, may be elected Delegate to a Municipal Assembly of People's Power. He/she shall also be required to be domiciled in the electoral district of the Municipality for which he/she is nominated.

 

For how long are the Delegates to the Municipal Assemblies of People's Power elected?

Delegates are elected for a term of two and a half years.

 

What is the fundamental content of the Delegate's accountability meetings?

Its fundamental content is expressed in the fact that the Delegate renders an account of the work carried out by him/her, offering information of interest, identifying problems and needs and promoting debate on them.

The Delegate will stimulate the proposals of possible solutions to the detected problems, will expose to what extent the neighbors can participate in them, promoting the work in the community and will stimulate those who stand out in the development of socio-cultural activities, work and in the defense of the conquests of the Revolution.

The Delegates shall report on the solutions given to the questions formulated by the electors and on those that have not been resolved by that time, shall offer a convincing answer; likewise, they shall collect the new questions formulated by the electors, to which they shall give the corresponding treatment.

 

Can the delegates to the Municipal Assemblies of People's Power have their mandates revoked?

Yes, their mandates may be revoked at any time, in the manner, for the causes and according to the procedures established by law.

 

How do the Delegates know the problems, difficulties, needs, criteria and opinions of the neighbors and voters?

In addition to the information received by the Delegates in the accountability processes, in the offices with the electors, in the diagnosis made by the Integrated Community Work Group and in their links with the mass organizations, they must travel around the district, exchange with the neighbors, visit the homes of the families, entities and institutions.

In this systematic link with the people, the Delegates obtain valuable information for their work, which allows them to act, make proposals and promote decision-making on issues that require it.
